Disability Services Provides
Definition of a person with a disability
According to Section 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act (ADA) of 1990, an individual with a disability is a person who 1) has a physical or mental impairment that substantially limits one or more life activities; or 2) has a record of such impairment; or 3) is regarded as having such impairment.
The college has two significant responsibilities:
- First, the college must not discriminate against individuals on the basis of disability. A 'qualified' individual with a documented disability is someone who, with or without reasonable accommodation, meets the essential eligibility requirements for the receipt of services or the participation in programs, services, or activities provided by this college. The college may not treat qualified individuals with disabilities differently from individuals without disabilities or have a policy that disparately impacts individuals with disabilities.
- Second, the college must provide access to its programs and services, and reasonably accommodate qualified individuals with documented disabilities to allow them to effectively participate in those programs and services.
The State of Minnesota has established grievance procedures that provide for prompt and equitable resolution of complaints alleging any action that is prohibited by Title II of the Americans with Disabilities Act (ADA).

It is the policy of the College to provide access to and encourage participation in programs, services, and activities to qualified individuals with known disabilities as required by Federal and State statutes. (Section 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act, 41 U.S.C.A. section G101) and the Minnesota Human Rights Act. The college will ensure compliance to the Minnesota State Colleges and Universities Policy 1B.4.
Students with certain types of disabilities should be aware that some programs and courses require specific physical abilities. Please consult with the instructor and/or campus counselor for advising, support services and accommodations prior to enrollment.
Each campus and the college will assist students with disabilities in achieving a successful college experience. There is designated staff member on each campus who will provides assistance. The campus will meet the building accessibility needs of the student. Minnesota West provides students with disabilities the tools to participate in the academic environment. Accommodations will be provided within reasonable means, as will support services. Advocacy by faculty and staff will be provided on behalf of students with disabilities including providing physical accessibility accommodations.
